Foreclosure
Foreclosure - it is a word that you hear every day. In Palm Beach County 30,000 new foreclosure cases were filed in 2009 and 29,000 were filed in 2008. That number is only expected to increase. While foreclosure currently affects thousands of the people in this area, your case is personal. I deal with each client on a personal level, not on a "one size fits all" basis. I limit my practice to Palm Beach and Broward Counties so that I can attend your hearing(s).
While you expected that the lender would begin foreclosure now that it has actually happened you have a lot of decisions to make. This website is a brief overview of who I am and how I can help you. I did not just jump on the foreclosure bandwagon. I have been involved with distressed property since 1990. I have also worked on the closing side of a real estate transactions so know what proper loan origination practices should be. For the last couple years I have refocused my practice to primarily real estate litigation and foreclosure defense.
I will explain your options to you even if those options include not hiring me. Some lenders now engage in a deed for keys program where you can deed your property back, provided it is clear of junior liens, and lease it back for up to one year at fair market value. If you have an imminent short sale you may want to see if that deal closes. Of course, you must be mindful of the 20 days that you have to respond to the foreclosure complaint.
Only the work necessary for your file will be done. Many attorneys have a "one size fits all" fee schedule or a monthly fee. Money is tight for everyone so while every file requires a certain amount of work not every file requires a full fledged defense. If discovery of your banking records and loan origination file are not necessary the work will not be done and you will not be charged for it. However, if your file warrants the work it will be done at a reasonable fee. There will be months were no work is done on your file - remember as a defendant it is not our job to push the lender along. Why pay every month if no work is being done on your behalf? In our initial meeting a plan for your case - not some generic case - will be decided.
No interest payment plans are available so that the entire fee does not have to be paid up front.
